Information obligation when providing personal data

M Grey V. s.r.o., with its registered office at Plynárenská 17560/3A, 821 09, Bratislava, ID: 53606663, TAX ID: 2121429057, registered in the Commercial Register of the District Court Bratislava I, Section: Sro, File No.: 150892/B (hereinafter also referred to as "the Controller") informs the data subject of the fulfilment of information obligations pursuant to Article 13 of the Regulation of the European Parliament and of the Council (EU) repealing Directive 95/46/EC (hereinafter referred to as "the Regulation") and Section 19 of Act No. 18/2018 Coll. on the Protection of Personal Data (hereinafter referred to as the "SPA Act") by dividing the information below.

Pursuant to Section 19(2)(e) of the SPA Act, the data subject is obliged to provide personal data for the above-mentioned purpose, otherwise it is not possible to match the demand and conclude a contract in which the data subject has expressed an interest.

  • Purpose of the processing of personal data for which the personal data are intended, as well as the legal basis for the processing of personal data:

    Objective: responding to demand and concluding a contract and pre-contractual relations


    Legal basis:

    § 13(1)(b).b) of the Personal Data Protection Act: the processing of personal data is necessary for the performance of a contract to which the data subject is a party or for the implementation of a pre-contractual measure at the request of the data subject

    The Controller hereby informs the customer, as the data subject, that in accordance with Art. 6(1)(1).b(b) of the Regulation, he/she will process personal data without the consent of the data subject in the process of concluding the purchase contract without the consent of the data subject, since the processing of personal data will be carried out by the controller within the framework of pre-contractual relations and the processing of personal data is necessary for the conclusion of the purchase contract.

  • Identification of the consignee or category of consignee, if any

    The recipients or categories of recipients who process personal data are:

    State institutions for the purpose of fulfilling the obligations of the controller: tax office, state administration and public authority for the exercise of control and supervision (e.g. Slovak trade inspection, office for personal data protection), bailiff, court, law enforcement authority, etc.

  • Retention period of personal data

    Period of storage of personal data: period of a certain period – the period specified by the law to exercise the rights and obligations arising from the concluded purchase contract (e.g. pursuant to Section 599(1) of the Civil Code, the buyer may exercise the rights of liability for defects in court within 24 months of receipt of the goods – the storage of personal data is therefore necessary for the identification of the party); longer processing of personal data is possible only for archiving purposes, for scientific purposes, for the purpose of historical research or for statistical purposes on the basis of a specific regulation.
  • Rights of the data subject

    The data subject has the right to:
    • require the controller to have access to personal data relating to the data subject;
    • to correct personal data;
    • to erase personal data or restrict the processing of personal data;
    • object to the processing of personal data as well as the right to the portability of personal data;
    • file an application to initiate proceedings pursuant to Section 100 of the SPA Act.
